Regulations of ”Elbląg Music Masterclass”

 

§1. GENERAL PROVISIONS

  1. The organizer of the "Elbląg Music Masterclass" (hereinafter referred to as the "Courses") is the Elbląg Chamber Orchestra (hereinafter referred to as the "Organizer").
  2. The Courses are addressed to students of 1st and 2nd degree music schools, university students and university graduates up to 35 years of age (hereinafter referred to as "Participants") and to other people interested in taking part in the Courses passively (hereinafter referred to as "Passive Participant") .
  3. As part of the Competitions, a "Young Virtuoso Competition" (hereinafter referred to as the "Competition") will be organized.
  4. The Course Participants can be musicians playing the violin, viola, cello, guitar, conductors or musicians playing in chamber ensembles.
  5. The jury deciding to qualify for the Courses and the Competition will consist of the professors of the Courses: Igor Petrushevski, Mariusz Patyra, Marek Czech, Marcel Markowski, Krzysztof Meisinger, Alexander Humala, Karolina Nowotczyńska - Director of EOK (hereinafter referred to as "Jury").
  6. The courses will be held on July 1, 2023 - July 9, 2023 in Elbląg.

§2. TERMS OF PARTICIPATION

1) As part of the Courses, the Participant is entitled to:

  • instrumental master courses,
  • free participation in the Competition
  • group jazz workshops,
  • lecture,
  • performance during at least one recital, max. two recitals,
  • free admission to all concerts organized as part of the event,
  • rehearsals with an accompanist,
  • free admission to selected cultural institutions in Elbląg,
  • exercise rooms,
  • at least 2 lessons with Elbląg Chamber Orchestra (for conductors only)

2) As part of the Courses, the Passive Participant is entitled to:

  • passive participation in master instrumental courses, after a prior arrangement with the professor,
  • group jazz workshops,
  • lecture,
  • free admission to all concerts organized as part of the event,
  • free admission to selected cultural institutions in Elbląg.

3) The Course Participant who is not a chamber ensemble may apply for the participation in the Competition.

4) The following fees apply for the participation in the Courses:

• Participant who is an instrumentalist - PLN 1,350.00,
• Participant who is a conductor - PLN 1,800.00,
• A participant who is a chamber ensemble - PLN 1,350.00. (the price applies to the entire ensemble)
• Passive Participant - PLN 700.00.

5) The fees set out in pt. 4 do not include the costs of accommodation and meals, which are incurred on one's own cost. The organizer provides a discount on accommodation for Participants and Passive Participants in "Our Dormitory" (Dormitory no. 3, 17 Wapienna Street, 82-300 Elbląg). The preferential booking price is valid for the password "Elbląg Music Masterclass".

6) The Participant and the Passive Participant under 18 years of age can participate in the Courses only under the supervision of an adult guardian, subject to pt. 7. The guardian's data should be provided in the application form in the "Additional information" section. The guardian has the right to free admission to all classes as part of the Courses and the Competition, and the right to a discount on the purchase of tickets to Elbląg cultural institutions.

7) The Participant and the Passive Participant in the age between 15 and 18 can participate in the Courses without a guardian only if they have a declaration in this regard signed by their parents / legal guardians. The statement should be sent via e-mail no later than till June 6th 2023 (statement form) to the e-mail address: https://elblagmasterclass@gmail.com.

8) The condition for the participation in the Courses is to fill in the application form available at https://elblagmasterclass.pl/en/20-apply between March 21st, 2023 (12:00) and May 31th, 2023 (23.59). myself. The organizer will confirm the acceptance of the application via e-mail by 06/06/2023.

9) The Participant being a chamber ensemble is supposed to enter the data of all the ensemble members in the "Additional information" section.

10) Application for the Courses is not tantamount to admission to the Courses. Participants and Passive Participants will be notified by the Organizer by e-mail about qualifying for the Courses. The organizer will confirm by e-mail the receipt of the application by June 6, 2023.

11) Participants of the courses will be selected on the basis of artistic CVs and information contained in the application form.

12) Depending on the number of applications received, the Organizer may decide to extend the recruitment period for the Courses, which will result in an extension of the deadline for the announcement of the recruitment results mentioned in pt. 10.

13) While applying for the Courses, the Participant can indicate in the application form the willingness to take part in the 'Young Virtuoso Competition'. The detailed information on participation in the Competition is described in §4 of Terms of Participation.

14) The decision to admit Participants to the Courses and to the Competition will be made by the Jury. Only applications that meet the formal conditions will be admitted to the jury's deliberation. The decision of the Jury cannot be appealed against.

15) The formal condition of the participation in the Courses is for the Participant to complete all the necessary fields in the application form.

16) The total cost of the participation in the Courses should be paid to the bank account specified in pt. 17 after receiving the notification of admission to the Courses by the deadline of June 20th, 2023. The day of payment for the Courses is the day on which the money is credited on the Organizer's bank account. In the event of failure to comply with the obligation, the Participant will be removed from the list of trainees.

18) The refund of the fee paid by the Participant or Passive Participant for the participation in the Courses may take place in the event of failure by the Participant or Passive Participant to join the Courses due to particularly important, documented and unpredictable events.

 

§3. ORGANIZATIONAL PROVISIONS OF THE COURSES

  1. As part of participation in the Courses, the Participant (violin, viola, cello, guitar, chamber ensembles) is guaranteed 4 lessons with the professor (60 minutes each) according to the schedule set by the Organizer. Moreover, each Participant (violin, viola, cello, guitar, chamber ensembles) can rehearse with an accompanist. The rehearsal schedule is set directly with the accompanist.
  2. As part of participation in the Courses, the Participant (conducting) is guaranteed 4 lessons with the professor (45 minutes each) according to the schedule set by the Organizer.
  3. The participant is obliged to be punctual, comply with the schedule of classes and take care of the Organiser's property and property made available to the Organizer by other entities for the duration of the Courses.
  4. In the event that the Lesson is shortened or does not take place for the reasons attributable to the professor, the Participant will be offered a different date of the Lesson in whole or in the appropriate part of the Lesson which was not realized (shortening more than 10 minutes).
  5. In the event that the Lesson is shortened or does not take place for the reasons beyond the Organizer’s responsibility, the Participant is not entitled to any claims.
  6. Lessons and materials received during the Lessons are informative and advisory and they are based on the proprietary program prepared by the professor. The organizer is not responsible for the content and course of the Lesson, or for the content of the materials.
  7. Each participant applying as a violinist will be given 2 lessons with professor Igor Petrushevski and 2 lessons with professor Mariusz Patyra. If the Participant wants to take lessons with only one professor of his choice, he is asked to provide information in the application form under "Additional information".
  8. Participants of the courses (violin, viola, cello, guitar, chamber ensembles) will take part in chamber workshops. The organizer will assign participants to teams during chamber workshops based on artistic experience. The list of chamber ensembles will be announced on the website www.elblagmasterclass.pl by June 20, 2023.
  9. Each Participant has the opportunity to notify the Organizer of their willingness to perform during open recitals, which will be organized in the concert hall of the Old Town Hall in Elbląg.
  10. The participant who wishes to perform during the recitals is obliged to send the Organizer his/her concert progrmme which will be performed as part of the recital. The concert programme is to be sent via e-mail to the address elblagmasterclass@gmail.com by 06/06/2022 at the latest. In the event of failure to fulfill this condition, the Participant will be removed from the list of recital performers.
  11. During the recital, the participant may perform solo or with an accompanist. The frequency and time of rehearsals for the concert with the accompanist are set individually by the Participant and the Accompanist. The participant is obliged to send a scan of the accompaniment notes of the selected piece by June 6, 2023 to the address elblagmasterclass@gmail.com
  12. The Organizer provides technical support for the concert and the audience service. The recitals and the Participants performing in those recitals will be broadly promoted in all information channels of the Organizer and the Partners.
  13. The participant should send the list of pieces which will be played during lessons with Professor and accompanist until 06.06.2023.
  14. Each Participant will receive a diploma of participation in the Elbląg Music Masterclass 2023.

 

§4. ORGANIZATIONAL PROVISIONS OF THE COMPETITION

1. Using the application form, the Participant can apply to participate in the Competition in one of the selected categories: violin, viola, cello, guitar, conductor and chamber ensembles.

2. The participation in the Competition is free of charge.

3. The competition will be divided into two stages:

  • The first stage will take place during individual classes with the professor - on the basis of the submitted application forms, the assessment of skills and the interview, the Professor who has given individual classes will make a decision on qualifying the Participant for the second stage of the Competition.
  • The list of people qualified for the second stage of the Competition will be published on the website elblagmasterclass.pl by July 6, 2023. Additionally, the Participants qualified for the second stage will be informed by the Organizer via e-mail.
  • After the Participant has applied for the competition via the application form, he/she is obliged to inform the Organizer about the selection of the piece that will be performed by the Participant in case he/she is qualified for the second stage of the Competition. The title of the piece selected from the Catalog (the catalog of pieces is available on the website elblagmasterclass.pl) should be sent to the Organizer via e-mail to the address elblagmasterclass@gmail.com by 06/06/2023 at the latest.
  • Chamber ensembles submit works they will perform during the Competition. The piece may be accompanied by an orchestra or without.
  • In the case of chamber ensembles, the selection of a piece must be consulted and approved by the Organizer.
  • In the case of the specialties: violin, viola, cello, guitar and conducting, the Organizer allows the performance of a piece from outside the Catalog in the Competition. Works outside the Catalog must be consulted and approved by the Organiser.
  • The second stage of the Competition will take place on July 7th, 2023, during the Participants' rehearsal with the Elbląg Chamber Orchestra. The Participants qualified for the second stage will have a rehearsal with the Elbląg Chamber Orchestra, during which they will present a piece selected from the Catalog for a solo instrument and a chamber orchestra. In the case of conductors it is supposed to be a piece for a chamber orchestra.
  • The performances given during the rehearsals will be assessed by the Jury. The Organizer will announce the list of the Competition winners on the website elblagmasterclass.pl after the Jury's deliberations. The Participants will also be informed via e-mail on July 7, 2023.

4. The Participants of the Competition will be awarded 2 Main Prizes. The first prize is a concert in a prestigious concert hall in Europe and a financial prize. The second prize is a concert at the Krakow Philharmonic and a financial prize.

5. Additional prizes are also planned in the form of a concert with the Elbląg Chamber Orchestra during the final concert crowning the Elbląg Music Masterclass on July 9, 2023 and attractive financial prizes.

6. Each of the Competition Participants will receive a diploma confirming their participation in the Competition.

7. The Organizer reserves the right not to award prizes or to award a special prize.

8. The decision of the Jury cannot be appealed against.

 

§5. RECORDING THE PERFORMANCES

 

  1. The Organizer has the right to record all activities being part of the Courses and the Competition.
  2. By applying for the Courses using the application form, the participant automatically expresses his/her consent for the classes with his/her participation to be recorded, including the use of his image and personal data.
  3. The consent Indicated in pt. 2 also constitutes consent to the free transfer to the Organizer of all proprietary copyrights to the pieces of music set by the Participant during the Courses or the Competition and all related rights to the artistic performances established by the Participant during the Courses or the Competition. The Organizer accepts works and artistic performances the moment they are determined by the Participant.
  4. The Organizer has the right to use the established pieces of music and artistic performances specified in pt. 3 in unlimited time and territory in the following ways:

- recording - recording of material on any audiovisual medium, in particular on: video carriers, photosensitive and magnetic tape and a computer disk,

- reproduction by any technique, including video and audio cassettes, audiovisual discs, celluloid, photosensitive and digital techniques, computer recording techniques,

- public playback and display (television, radio, multimedia, internet transmission, etc.),

- broadcasting in whole or in fragments freely selected by means of wired, wireless vision and sound, by any technique - regardless of the system, standard and format, including broadcasting via a ground station and cable broadcasting,

- entering into computer memory and multimedia networks,

- making the work available to the public so that everyone can have access to it in a place and time chosen by them,

- any use of the material on interactive services made available to viewers via the Internet and other data transmission techniques, including telecommunications, IT and wireless networks.

 

§6. USE OF THE IMAGE


1. When registering for the Courses using the application form, the Participant is obliged to complete a declaration of consent to the use of the Participant's image, only for information and promotional purposes of the Elbląg Music Masterclass event. (statement form)


2. In the case of underage participants, a declaration of consent to the use of the Participant's image should be completed by the child's parent or legal guardian. (statement form)


3. Consent to recording the image during the Elbląg Music Masterclass event organized by the Elbląg Chamber Orchestra and the free and unlimited use and dissemination of this image by posting photos and recordings on the following websites: www.elblagmasterclass.pl, www.eok.elblag.eu, and on social media profiles (Elbląg Music Masterclass and Elbląg Chamber Orchestra) applies only to information and promotional activities of the Elbląg Music Masterclass event.

 

§7. FINAL PROVISIONS

 

  1. All issues not included in the Regulations are settled by the Organizer.
  2. Application to participate in the Courses is tantamount to acceptance of these Regulations. In the event the Regulations fail to be complied with, the Organizer reserves the right to remove the Participant and the Passive Participant from the Courses.
  3. The organizer reserves the right to amend these Regulations in writing.
  4. The Regulations come into force on the day the recruitment process is started by the Organizer.
  5. In the case of the so-called force majeure, the Organizer reserves the right to cancel the Courses. Force majeure are events independent of the will of the parties to the contract, significantly affecting the possibility of organizing the Courses, having a unique and significant nature, in particular such as:
  6. entry into force of the regulations or issuing orders by the relevant services imposing a ban on conducting ceremonies and cultural events results,
  7. results of operation of the forces of nature, in particular flood, fire, earthquake,
  8. acts of war or other operations of armed forces and acts of terrorism.
  9. The Regulations are available on the Organiser's website.

1) Pursuant to Art. 13 sec. 1 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data
and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter: GDPR, we would like to inform you that the administrator of your personal data is Elbląska Orkiestra Kameralna with its registered office in Elbląg at ul. Old Market 25
2) On the basis of applicable regulations, we have appointed a Data Protection Officer who can be contacted:

3) Personal data obtained in connection with the conclusion of a contract with you will be processed
for the following purposes:
• related to the implementation of the contract signed with you; related to the pursuit of possible claims, compensation; responding to your letters, requests and complaints; providing answers in pending proceedings.
4) The legal basis for the processing of your data is:
• necessity to perform the contract or to take action at your request before concluding the contract (Article 6(1)(b) of the GDPR),
• the need to fulfill the legal obligation incumbent on the administrator (Article 6(1)(c) of the GDPR),
• necessity for the purposes of the legitimate interests pursued by the administrator (Article 6(1)(f) of the GDPR).
5) Providing personal data is voluntary, but necessary to conclude and perform the contract.
6) The personal data obtained from you may be transferred:
• entities processing them on our behalf and public authorities or entities authorized to obtain data on the basis of applicable law, e.g. courts, law enforcement authorities or state institutions, when they make a request based on an appropriate legal basis.
7) Your data will not be transferred to third countries.
8) The period of processing your personal data depends on the purpose for which the data is used
are processed. The period for which your personal data will be stored is calculated based on the following criteria:
• the duration of the contract, legal provisions that may oblige us to process data for a certain period of time, the period that is necessary to defend our interests.
9) In addition, we inform you that you have the right to:
• access to your personal data; request rectification of your personal data, which
are incorrect and supplement incomplete personal data; request deletion of your personal data, in particular in the event of withdrawal of your consent to processing, when there is no other legal basis for processing; requests to limit the processing of your personal data; object to the processing of your data, due to your particular situation, in cases where we process your data on the basis of our legitimate interest or for direct marketing purposes; transferring your personal data; lodge a complaint with the supervisory body dealing with the protection of personal data, i.e. the President of the Office for Personal Data Protection
10) To the extent that your data is processed on the basis of consent - you have the right to withdraw your consent to data processing at any time. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of your consent before its withdrawal. You can withdraw your consent by sending a declaration of withdrawal of consent to our correspondence address or e-mail address.
11) Please be advised that we do not use systems for automated decision making.
